Intellectual property includes research works, literary works, dramatic works, artistic works, musical works, audio-video works, film works, photography, sculptures, broadcast works, recorded works, software, e-mail, web-sites, radio and television broadcasts etc. According to the World Intellectual Property Organization (WIPO), 'Intellectual Property refers to creations of mind: Inventions, literary and artistic works, and symbols, names, images, and designs used in commerce'.
Just as human material assets cannot be enjoyed or used by anyone other than the owner without permission or payment, the same applies to intellectual property. Every intellectual work is protected by copyright or authorship in copyright law.
Copyright activities always involve multiple parties. In the case of literature, writers, publishers and readers, in the case of music, songwriters, composers, singers, instrumentalists and publishers or producers of musical works, in the case of films, storytellers, producers, directors, actors, actresses, singers, co-artists are involved. Worldwide, the living author and the author's legal heirs after his death receive royalties from works for fifty to seventy years. Under Bangladeshi law, this right remains in force for sixty years after the death of an author. However, even though the copyright office has been established in Bangladesh for nearly fifty years, no association can be found to protect the interests of the owners of literature, music or any other creative works. All over the world, this society is standing by the side of talented people and accelerating their passion for work.
The main threat to intellectual property is piracy, which means theft of intellectual property. Now foreign books, movies, music and computer software etc. are widely piracy. A minimum of one to one and a half crore rupees is currently required to make a movie in Bangladesh. Copyright registration is not mandatory. Copyright registration is also not mandatory under international law. But copyright registration is essential to avoid ownership disputes. According to copyright law in Bangladesh, the term of copyright for works other than photographs, recordings and motion pictures is 60 years after the death of the author. Copyright matters in Bangladesh are governed by the Copyright Act-2000 (amended in 2005). As a member country of WIPO, Bangladesh is obliged to comply with all copyright conditions including the relevant TRIPS (Trade Related Aspects of Intellectual Property Rights) agreement due to being a member of Berne Convention, Universal Copyright Convention (UCC) and World Trade Organization (WTO). Realizing the importance of copyright at the national and international level, Bangladesh Copyright Act-2000 was formulated in accordance with the International Copyright Act and this Act was amended in 2005 to modernize it.
Copyright Rules-2006 (S.R. and No. 219-Act/2006) was formulated under the provisions of Section 103 of the Copyright Act with the aim of strengthening copyright management with proper enforcement of the law. Copyright law in Bangladesh is also an adaptation of British and Pakistani law. Copyright law was first enacted in England in 1709. Through an amendment in 1914, the subcontinent was brought under the copyright law. After the partition of the country, the Government of Pakistan repealed the Copyright Act of 1914 and issued an Ordinance called 'Copyright Ordinance' in 1962 and established the Central Copyright Office in Karachi. Later a Regional Copyright Office was established in Dhaka. In the post-independence period, the Government of Bangladesh amended some clauses of the Ordinance of 1962 through a law approved by the National Parliament in 1974 and gave the regional offices the status of national level offices. At that time this office was associated with the Ministry of Education. Later the Copyright Office was merged with the Ministry of Cultural Affairs. At present, the Copyright Office is a quasi-judicial institution at the national level. It should be noted that Copyright Office, Dhaka worked under the revised Ordinance of the Pakistani era (of 1962) and the Copyright Rules of 1967 until the promulgation of the Copyright Act in 2000, ie until 1999.
A task force has been formed by the government with the aim of proper implementation of copyright law with the concerned parties. In the meantime, the task force has recovered pirated goods from several markets in the capital, Dhaka. Initiatives have been taken at the Ministry level to schedule the Copyright Act under the Mobile Courts Ordinance, 2009 with a view to prosecuting copyright related offenses within a short period of time.
